Junk Fax Prevention Act
- [Narrator] The Junk Fax Protection Act of 2005 extended protections against telemarketing activities to cover fax machines as well. Now the Telephone Consumer Protection Act actually did regulate junk faxes when it was issued. But the Junk Fax Protection Act clarified some of those responsibilities. The basic rule is straightforward. It is illegal to send an unsolicited advertisement by fax. There is no exception to this rule for accidental transmission and anyone who sends an unsolicited advertisement may be fined $500 per page. And if a court finds that the transmission was willful or knowing, that fine may be increased to $1,500 per page. The JFPA does allow sending faxes when the recipient consents to receiving messages by fax. It also says that consent is implied if the sender and recipient have an existing business relationship.
