Torts and negligence

- [Instructor] Torts are another form of civil violation. Torts do not involve a contract, but instead, involve harm to one party caused by the actions of another party. The party who caused the harm is said to have committed a tortious act. Negligence is a commonly occurring tort that occurs when one party causes harm to another party by their action or lack of action. The theory of liability for negligence involves four elements. First, there must be a duty of care. The person accused of negligence must have an established responsibility to the accuser. This may come from the nature of the relationship between the parties. For example, a physician has a duty of care to his or her patients that they will exercise good medical judgment. Second, there must be a breach of that duty of care.
